DEATH of EMPLOYER

Semua orang tidak suka bercakap mengenai ‘death’. Tetapi ini adalah topik yang dah biasa keluar. What happen when your partner (in body corporate ) dies. What will happen if your employer dies. Tapi tak pernah keluar soalan ‘What happen if YOU dies?’

Lets say En Amat (your employer) telah melantik syarikat anda sebagai arkiteknya membina sebuah bungalow bernilar RM5juta.Pembinan ditapak telah bermula apabila En Amat tiba tiba meninggal dunia. Anak perempuannya Miss A ( yg cantik jelita ) mewarisi rumah yang belum siap tersebut ( konon konon tak ada perebutan antara adik beradik lah ) dan 3.5 bulan kemudian ingin meneruskan pembinan rumah tersebut.

SOALANNYA, apakah implikasi dan langkah langkah yang anda ambil untuk menjaga kepentingan anda sebagai professional mengenai

a) perlantikan syarikat anda sebagai arkitek projek

b) status kontrak bangunan

c) PBT

ENGAGEMENT

-MOA ceased as party to the agreement dies. Right to recover fees for work done up to the date, based on Scale of Minimum Fees (SOMF) + 5% service tax + reimbursable incurred.

step 1 – Establish successor. Write to successor, inform her of the status and REAFIRM your position as original architect for the project.

step 2 – Seek re-appointment (by her) to continue as a qualified person for the project. Scope of work , Fees will be the same as previous SOMF. Make claim for fees on work done to new owner (obviously).

BUILDING CONTRACT

-Building Contract ceased operation.

-Inform contractor.

-Issue AI to postpone work on site (21.4 ? pls chk).

-secure site to protect public health / security.

-Do assessmet / certification in a form of pro-forma to determine work done, work in prooress, material on site. This is to establish contractors entitlement.

-Contractor entitled to determine contract (after 1 month) & claim for damage . Clause26

AFTER 3.5 months

-If contractor did not determine, he is entitled for

work done before suspension

EOT (23.7(v) – AI postponement 21.4

loss/expenses

Architect to advise new owner to enter/continue building contract with existig contractor.

If contractor DETERMINED,

he is entitled to payment for work done + loss / expenses 24.2(ii)

Engage new contractor to complete project.

LOCAL AUTHORITIES (LA)

1- Inform Local authorty in writing with relevant document

2- Inform LA about steps taken to ensure security on site and public health&safety.

After 3.5m

upon confirmation from new owner to continue with project,

1- submit form B – resumption with project

2- inform LA that Miss A is the new owner and you are STILL the Qualifed Person for the project.

After the building is completed, take her out for a nice dinner… ;- ) ( no extra marks here, though )
